Key Facts —DRT proceedings in India
The Recovery of Debts and Bankruptcy Act, 1993 (Section 1(4)) vests jurisdiction in Debt Recovery Tribunals for bank and financial institution claims above ₹20 lakh.
Claims below the DRT threshold are filed in civil courts under the Code of Civil Procedure, 1908, typically as a money suit or summary suit under Order XXXVII.
A Recovery Certificate issued under Section 19 of the RDBA, 1993 is executable as a civil court decree.
DRT Chennai has jurisdiction over Tamil Nadu and Puducherry for eligible financial institution debts.
An appeal against a DRT order lies to the Debt Recovery Appellate Tribunal (DRAT) under Section 20 of the RDBA, 1993.
Non-compliance with a Recovery Certificate may lead to attachment and sale of the judgment debtor's property under the Second Schedule to the Income-Tax Act, 1961 (applied via RDBA rules).
If you are a bank, NBFC, or financial institution with an unpaid debt above ₹20 lakh, your primary forum in Tamil Nadu is the Debt Recovery Tribunal, Chennai not the civil court. For businesses and individuals recovering money outside that threshold, issuing a legal demand notice for debt recovery before filing a civil suit or summary suit under Order XXXVII CPC can often facilitate an early resolution.
Which forum hears your recovery claim?
Section 17 · Section 19 · RDBA 1993 · Order XXXVII CPC
DRT Chennai
Bank and financial institution debts above ₹20 lakh. Conferred jurisdiction under Section 17, RDBA 1993.
City Civil Court
General money suits and commercial disputes outside DRT threshold. Filed under CPC 1908.
Madras High Court
Original side jurisdiction for high-value commercial disputes. Letters Patent and CPC apply.
Consumer Commission
Consumers alleging deficiency of service with a monetary claim, under Consumer Protection Act, 2019.
The limitation period for a money suit is ordinarily three years from the date the debt became due, under Article 18 of the Limitation Act, 1963.
Before initiating an execution petition for money decree, a creditor must obtain a decree in a money recovery suit, which legally determines the debtor’s liability.
How does the DRT process work?
Section 19 · Section 20 · RDBA 1993
File Original Application (OA)
The creditor files an OA before DRT Chennai under Section 19, RDBA 1993, supported by documentary evidence of the debt.
Hearing and adjudication
The Presiding Officer examines the claim; the debtor may file a counter-claim. Interim orders including attachment before judgment are available.
Recovery Certificate
On a successful OA, DRT issues a Recovery Certificate enforceable through the Recovery Officer, with powers of attachment and sale.
FAQ
1.Can I file a recovery suit without a lawyer?
You may appear in person before civil courts, but DRT proceedings involve procedural complexity and evidence requirements under the RDBA, 1993 that make legal representation advisable. At Aran Law, we advise creditors on filing Original Applications and managing interim attachment orders.
2.What is the time limit for filing a money recovery suit?
The general limitation period is three years from the date the debt becomes due, under the Limitation Act, 1963.
3.Does DRT Chennai handle all debt claims in Tamil Nadu?
DRT Chennai has jurisdiction over Tamil Nadu and Puducherry, but only for claims by banks and financial institutions as defined under the RDBA, 1993, above ₹20 lakh. Other commercial debts are litigated in civil courts or Madras High Court.
4.What can a court or DRT order against the debtor?
DRT may issue a Recovery Certificate under Section 19, RDBA, 1993, authorising the Recovery Officer to attach and sell movable and immovable assets. Civil courts may pass a decree executable by attachment of property or arrest of the judgment debtor in limited circumstances.
5.What is the difference between a DRT suit and filing under SARFAESI?
SARFAESI (Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002) allows secured creditors to enforce security interests without court intervention for loans above ₹1 lakh. VERIFY: current SARFAESI threshold. A DRT OA is the route when SARFAESI is unavailable or challenged.
