Anticipatory bail under Section 438 CrPC is a direction to release a person on bail in anticipation of arrest. An application is filed before the Sessions Court or the Madras High Court. The court considers the nature of accusation, the applicant’s antecedents, and the risk of absconding.
Incorporation under the Companies Act, 2013 requires a Director Identification Number (DIN), Digital Signature Certificate (DSC), and filing the Memorandum and Articles of Association with the ROC. Post-incorporation steps include GST registration, professional tax registration, and annual MCA filings.
Property registration under the Registration Act, 1908 requires a sale deed, encumbrance certificate, patta, property tax receipts, and identity proof of both parties. The deed must be executed on stamp paper of the value prescribed under the Tamil Nadu Stamp Act and presented before the jurisdictional Sub-Registrar.
Debt recovery may proceed through civil courts by money suit, through the Debt Recovery Tribunal (DRT) for bank claims above ₹20 lakhs, or under Order XXXVII CPC for summary suits. The SARFAESI Act, 2002 allows secured creditors to recover dues without court intervention in certain cases.
Arbitration under the Arbitration and Conciliation Act, 1996 is a private, consensual process where parties refer disputes to arbitrators whose award is binding. Unlike civil court proceedings, arbitration is generally faster, confidential, and allows parties to choose their adjudicator, subject to an arbitration agreement.
