ORISSA HC: ALL PARTIES MUST AGREE TO THE DOCUMENT BEFORE COMPARING HANDWRITING SPECIMEN. – According to the Orissa High Court, the wording “admitted or proved to the satisfaction of the court” in Section 73 of the Evidence Act requires that the document used for writing/signature comparison be uncontested and that all parties in the dispute admit the base document’s sample writing/signature.

HC: JUDGES IN CHILD SEXUAL ASSAULT CASES MUST HAVE BOTH A SENSITIVE HEART AND AN ALERT MIND. – In order to prevent further trauma, shame, and internal suffering for the kid, the Delhi High Court has stated that it is the responsibility of every court to have a compassionate heart and an alert mind when recording and conducting trials in sexual assault cases.

DEL HC: IF COURT FEES ARE NOT REFUNDED FOR UNADJUDICATED LIST, IT WOULD DISCOURAGE LITIGANTS – According to the Delhi High Court, denying a petitioner their right to a court fee refund in an unresolved lawsuit will deter them from seeking justice, and any civilised society would greatly benefit from avoiding such docket exclusion.

Justice System Must Modernise and Adapt to Technology – The Supreme Court has noted that if some judges are uncomfortable with e-files, the solution is to give them training rather than continuing with outdated and antiquated methods of functioning; the judiciary must modernise and adapt to technology, and tribunals like NCLAT cannot be an exception to this rule.
